    No, they would request it or serve the owner a subpoena. We also have a motion to preserve evidence we could serve the owner which basically orders them not to destroy or erase the tape while waiting for a subpoena.

    However, in my state a liquor store or medical marijuana establishment is required (by state statute) to turn over and video evidence, receipts etc. upon demand – or face losing their license and a civil fine. I think there is a few other types of business but I can’t remember off hand.

    The police can’t just kick the door in to take it.

    They would need to have a warrant to seize it, which would be easy to do given the facts of the case.
